Welcome to Yacht Protection Concepts ("YPC", "we", "us", "our"). We operate this website and store to provide a curated selection of marine products and related services (the "Services"). These Terms of Service (the "Terms") govern your access to and use of the Services. By using the Services, you agree to these Terms and our Privacy Policy.

1. Eligibility & Accounts

  • You must be the age of majority in your state to use the Services.
  • You agree to provide accurate, current, and complete information and to keep your credentials secure. You are responsible for all activity under your account.
  • Accounts may not be transferred, sold, or assigned.

2. Products & Content

  • We aim to display products accurately; actual colors/finishes may vary by device and lighting.
  • Descriptions, availability, and pricing may change at any time without notice.
  • We may limit quantities or refuse service where appropriate.

3. Orders

  • Your order is an offer to buy; we may accept or decline at our discretion. An order is accepted when we confirm and process payment.
  • Once accepted, cancellation requests may not be possible.
  • Returns and refunds are governed by our Return & Refund Policy.
  • Purchases are for personal/household or onboard use only and not for resale or export.

4. Prices, Payments & Taxes

  • Prices may change without notice; the price at checkout applies. Taxes, shipping, freight delivery fees, duties, and other fees are additional unless stated otherwise.
  • You authorize us (and our payment processors) to charge your selected payment method for all amounts due.
  • You are responsible for applicable taxes, duties, and import charges, if any.

5. Shipping & Risk of Loss

  • Shipping is governed by our Shipping Policy. Delivery windows are estimates and not guarantees.
  • Title and risk of loss transfer to you when we deliver items to the carrier.
  • Force majeure: we are not liable for delays caused by events beyond our reasonable control (e.g., weather, port congestion, carrier disruptions).
  • Freight Delivery Appointments: For oversized or freight shipments, the carrier will contact you to schedule a delivery appointment. YPC is not responsible for delivery delays caused by the customer's failure to schedule, reschedule, or be present for a freight delivery appointment. Additional storage or redelivery fees charged by the carrier in such cases are the customer's responsibility.

6. Product Use & Installation

  • Some products require professional installation and/or adherence to manufacturer instructions and applicable marine regulations.
  • You are responsible for proper selection, installation, use, and maintenance of products. We are not liable for damage or injury arising from improper installation, misuse, or failure to follow instructions.

7. Intellectual Property

All content on the Services is owned by YPC or our licensors and protected by intellectual property laws. You may use the Services for personal, non-commercial use only. No licenses are granted except as expressly provided.

8. Third-Party Services & Links

We may integrate services, tools, or content from third parties. Access is provided "as is" and at your discretion. We are not responsible for third-party sites, terms, or practices—review their policies before use.

9. User Content & Reviews

If you submit reviews, photos, or other content, you grant YPC a non-exclusive, worldwide, royalty-free license to use and display that content for operating and promoting the Services. You represent you have the rights to submit it and that it complies with law and these Terms.

10. Prohibited Uses

You may not use the Services for unlawful, infringing, harmful, misleading, or abusive activity, to interfere with security or operations, or to scrape, spam, or circumvent protections. We may suspend or terminate access for violations.

11. Export, Sanctions & Compliance

You agree to comply with all applicable export control, sanctions, and maritime regulations and not to use or ship products in violation of such laws.

12. Warranty Disclaimer

Except as required by law or expressly stated in writing, the Services and products are provided "as is" and "as available" without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. Some jurisdictions do not allow certain disclaimers; those limits may not apply to you.

13. Limitation of Liability

To the fullest extent permitted by law, YPC and our affiliates will not be liable for indirect, incidental, special, consequential, or punitive damages, or loss of profits, revenue, data, or goodwill. Our total liability for any claim arising out of or relating to the Services or products will not exceed the amount you paid for the product giving rise to the claim.

14. Indemnification

You agree to defend, indemnify, and hold harmless YPC and our affiliates from claims and expenses arising from your breach of these Terms or misuse of the Services.

15. Changes to the Services or Terms

We may update the Services or these Terms from time to time. We will post updates on this page and, where required, provide notice. Your continued use constitutes acceptance of changes.

16. Governing Law & Venue

These Terms are governed by the laws of the State of Florida, without regard to conflicts of laws principles. You consent to exclusive jurisdiction and venue in the state and federal courts located in Broward County, Florida.

17. Miscellaneous

  • If any provision is unenforceable, the remainder remains in effect.
  • No waiver is implied by a failure to enforce a provision.
  • You may not assign your rights without our consent; we may assign in connection with a corporate transaction or by law.

17A. Gift Cards

Yacht Protection Concepts ("YPC") Gift Cards are issued digitally and redeemable exclusively through our website at yachtprotectionconcepts.com. Gift cards may be used toward eligible products and combined with other payment methods at checkout.

  • Expiration & Fees: YPC Gift Cards do not expire and carry no service or inactivity fees.
  • Non-Refundable Purchase: All gift card sales are final and cannot be refunded, returned, or exchanged for cash, except where required by law. Discount codes do not apply to gift card purchases.
  • Loss or Theft: Please treat gift cards like cash. YPC is not responsible for lost, stolen, or unauthorized use once issued.
  • Corporate or Custom Gifting: For custom values or corporate gifting inquiries, please contact our concierge team at support@yachtprotectionconcepts.com.
